Frequently Asked Questions (FAQ)

Q: What is a Will?

A: A Will is a legal document that outlines your wishes regarding the distribution of your assets and the care of any minor children upon your death.

Q: Who can write a Will?

A: Any adult who is of sound mind can write a Will. This generally means someone who is at least 18 years old and has the mental capacity to understand the nature and consequences of creating a Will, the extent of their assets, and the identity of their beneficiaries.

Q: Why is it important to have a Will?

A: Having a Will ensures that your assets are distributed according to your wishes, reduces potential conflicts among surviving family members, and can expedite the legal process of handling your estate. Without a Will, the Distribution Act 1958 (applicable for Peninsular Malaysia and Sarawak) or Intestate Succession Ordinance 1960 (applicable for Sabah) will determine how your assets are divided, which may not align with your desires.

Q: At what age should I consider writing a Will?

A: It’s wise to consider writing a Will once you reach adulthood, especially if you have dependents, significant assets, or specific wishes for your estate. Life events such as marriage, the birth of a child, or the purchase of property are key times to create or update your Will.

Q: What happens if I die without a Will?

A: Dying without a Will, known as intestate, means your estate will be distributed according to Distribution Act 1958 (applicable for Peninsular Malaysia and Sarawak) or Intestate Succession Ordinance 1960 (applicable for Sabah), which may not reflect your personal wishes. This can result in unintended beneficiaries and potential disputes among family members.

Q: What should I include in my Will?

A: Your Will should include:

Personal information and testamentary intent

Appointment of an executor or executors

Specific bequests of property and assets

Guardianship designations for minor children (if applicable)

Q: How often should I update my Will?

A: You should write and possibly re-write your Will after major life events such as marriage, divorce, the birth of a child, or significant changes in your financial situation. Even without significant changes, it's good practice to review your Will every 3-5 years.

Q: Who can be a witness to the testator's Will?

A: Generally, any adult who is of sound mind and not a beneficiary or spouse of a beneficiary can be a witness to the signing of your Will. You will need to get two (2) witnesses to your Will.

Q: When will a Will come into effect?

A: A Will comes into effect upon the death of the testator.

Q: What are the advantages of writing a Will?

A: The advantages of writing a Will include ensuring your assets are distributed according to your wishes, appointing guardians for minor children (if applicable), reducing family disputes, expediting the Grant of Probate process, and potentially reducing legal fees.

Q: What happens if I acquire additional assets in the future after writing my Will?

A: If you acquire additional assets after writing your Will, the additional assets will be distributed according to the portion in the residue clause. If you wish the additional assets not to be distributed according to the residue portion, you should re-write your Will to include these assets.

Q: How long does it take to obtain a Grant of Probate?

A: The time to obtain a Grant of Probate can vary, but it typically takes between 3 to 6 months after submitting the application, provided there are no complications. Complex estates or disputes can extend this timeframe.

Q: What is an executor, and what do they do?

A: An executor is a person you designate to carry out the instructions in your Will. Their duties include managing your estate, paying debts and taxes, and distributing assets to your beneficiaries.

Q: How do I appoint an executor?

A: To appoint an executor, clearly state their name and contact information in your Will. You should also discuss your decision with the person you choose to ensure they are willing to accept the role.

Q: How many executors can I appoint?

A: You can appoint one or maximum of 4 executors (need to act jointly). It is always recommended to appoint an alternate executor who can step in, if the primary executor is unable or unwilling to fulfill the executory duty. It's important to choose individuals who are trustworthy, organized, and capable of handling the responsibilities.

Q: How soon can I get my Will after payment and approval?

A: The timeline for receiving your completed Will can vary, but typically, once all necessary information is provided, you can expect to receive your draft within 3 working days. After reviewing and payment is done, the final Will, will be ready within 1 to 2 weeks for you and your witnesses to sign.

Q: When can I still amend my approved Will and what would be the cost involved?

A: You can amend your Will within 30 days after it has been approved. A fee of RM10 will be charged for the amendment, along with an additional RM80 for printing fees. If there are any additional clauses added, the charges would be according to our fees schedule.

Q: What if I want to re-write, add, or amend my Will after 30 days?

A: If you wish to re-write, add, or amend your Will after the 30-day period, you will receive a 50% discount on the previously paid fees (excluding custodian, consultation fees, and any previous discounts). Additionally, an RM80 printing fee will be charged.

Estate Planning

Having a Will is like leaving a map for your loved ones after you're gone. It ensures that your wishes are carried out and your assets are distributed according to your wishes. Here are some key reasons why having a Will is important:

Control Over Your Assets: A Will allows you to decide who receives your property and assets after your passing. Without a Will, intestacy laws dictate how your estate will be distributed, which may not align with your wishes.

Guardianship for Minors: If you have children who are minors, a Will allows you to appoint a guardian of your choice to take care of them in the event of your death. This ensures that your children are cared for by someone you trust.

Avoiding Family Disputes: A clear and legally binding Will can help prevent conflicts and disagreements among your family members regarding the distribution of your assets. It provides clarity and reduces the likelihood of disputes.

Peace of Mind: Having a Will provides peace of mind, knowing that your affairs are in order and your loved ones will be taken care of according to your wishes. It also relieves your family of the burden of making difficult decisions during an already emotional time.

Overall, having a Will is a crucial aspect of estate planning that ensures your assets are distributed according to your wishes and helps provide for the well-being of your loved ones after you're gone.
